النيابة توجه تهم ضد مضوي وآخرين تصل عقوبتها للإعدام

وجهت نيابة أمن الدولة رسميا تهم ضد الناشط الحقوقي الدكتور مضوي إبراهيم آدم وآخرون شملت المواد التالية (66، 65، 64، 53، 51، 50 و21) من القانون الجنائي لسنة 1991.والمادة (23) من قانون تنظيم العمل الطوعي 2006. والمادة 17 من قانون جرائم المعلوماتية التي تصل عقوبة بعضها الإعدام. فيما أكد رئيس نيابة أمن الدولة بابكر عبد اللطيف الفراغ من التحريات وفتح بلاغ بالرقم (2017/ 22) وتوجيه التهم رسمياً للمتهمين.
من جانبه قال رئيس هيئة الدفاع عن مضوي الأستاذ المحامي نبيل أديب إن هذه التهم وجهت منذ 3 أسابيع، ومنذ ذلك الحين فضل الدفاع عدم الاستئناف وطلب إحالة القضية للمحكمة كسباً للوقت، وشددت هيئة الدفاع على ضعف الاتهامات، مطالبة بالإسراع في إحالة الملف للمحكمة. وأضاف أديب التهم تشمل نشر تقارير كاذبة، تقويض النظام الدستوري، التجسس، إثارة الحرب ضد الدولة، إثارة الكراهية بين الطوائف وإدارة منظمة إرهابية. وعلى ذمة ذات القضية يواجه حافظ إدريس المعتقل منذ أواخر نوفمبر الماضي اتهامات نيابة أمن الدولة، على خلفية عمله كمعاون قانوني في رصد انتهاكات حقوق الإنسان بحق النازحين في دارفور.

The Prosecution Office files capital crimes against Mudawi and others.

The State Crimes Prosecution Office has officially filed charges against Dr. Mudawi Ibrahim and others under the following articles of the 1991 Sudanese Criminal Code:

Article 21- Criminal conspiracy
Article 50- Undermining the constitutional system
Article 51- Waging war against the state
Article 53- Espionage against the country
Article 64- Provoking hatred against or amongst sects
Article 65- Participating in a criminal or terrorist organization; and
Article 66- Publication of false news

Dr. Ibrahim was also charged under Article 23 of the Voluntary and Humanitarian Work Act of 2006 and Article 17 of the Information Crimes Act. The head of the prosecution office, Babiker Abdellateef has confirmed that the investigations have ended and the case file has been opened under number 22/2017 and the defendants are now officially facing charges.

From his side, the head of the defense team, Nabil Adib, said that the charges were filed three weeks ago and their team has not appealed this, so the case file should be litigated in court. The defense team reiterated that the charges are weak and asked that the file be swiftly taken to court. The other accused are Hafiz Idris, who has been detained since last November for his work as a paralegal documenting violations against IDPs in Darfur, and Tasneem Hashim, who was detained for over three months before she was released earlier this year.

Update:

It should be noted that a court session scheduled for the June 15 was postponed to July. Moreover, during the second session, the court asked for the re-arrest of Hashim who had fled the country following her release. The court said that the Sudanese Embassy in Cairo should take the lead in pursuing the defendant and distributing her picture and information in all newspapers in Egypt. If this was to no avail then the case would go on without her and her case will be severed into a separate case file.
