محكمة الاستئناف تلغي حكم الإعدام على نورا وتستبدله بالسجن مع الدية

ألغت محكمة استئناف جنايات أم درمان ، يوم الثلاثاء الموافق 26 يونيو 2018 ،حكم الإعدام الصادر ضد نورا حسين المدانة بقتل زوجها تحت المادة 130 (القتل العمد) من القانون الجنائي السوداني لسنة 1991م ، واستبدلته بعقوبة ( القتل شبه العمد) وعقوبتها السجن مدة خمسة أعوام مع دفع الدية. وقال المحامي الفاتح حسين عضو هيئة الدفاع عن نورا حسين، إن المحكمة ألغت الإدانة الصادرة تحت المادة 130 القتل العمد ، موضحاً إن فترة السجن تحسب من تاريخ دخول الحراسة بتاريخ 3 مايو 2017 ، بالإضافة إلى دفع دية قدرها 337500 جنيه. وكانت نورا حسين قد ذكرت في حيثيات قضيتها أن زوجها اغتصبها بعد أن ظلت ترفض معاشرته جنسيا بسبب رفضها الزواج منه بالأساس بمعاونة عدد من أقاربه مما دفعها تسديد طعنات أدت إلى قتله. فيما لا تذال هناك درجات تقاضى بالمحكمة العليا مكفولة للأطراف.
The National Court of Appeal Overrules Nura’s
26th June, 2018

On Tuesday, 26th June, the national court of appeal of Omdurman overruled the death sentence that was given to Nura for murdering her husband according to Article 130 of the 1991 Sudanese constitution that states of intentional manslaughter. The sentence was overturned to unintentional homicide, whose punishment is a five-year sentence and payment of Diya (money in compensation for the family of the victim).
Al-Fateh Hussein, a member of the law firm defending Nura, said that court of appeal counted the time Nura was incarcerated as time served on her five-year sentence. She was detained on 3rd May, 2017and the Diya was set at 337,500 Sudanese Pounds.
Nura went on to explain during her court cross-examination that her husband raped her after she refused to consent to have sexual intercourse with him. He then raped her with the help of a number of his relatives, which angered her and she stabbed him, leading to his death.
