محكمة بأم درمان تقضى بالاعدام شنقاً لمدان بإغتصاب ثلاث أطفال أشقاء

أصدرت محكمة الطفل بمقرها بمجمع محاكم أم درمان وسط، قراراً يقضى بإعدام المتهم بشير محمد أحمد،البالغ ثلاثين عاماً، وهوصاحب متجر(بقالة) شنقاً حتى الموت بعد إدانته باغتصاب ثلاثة أطفال أشقاء صبيان وفتاة تتفاوت أعمارهم بين ثلاث إلى خمسة أعوام بمنطقة الصالحة جنوب أم درمان . وأمرت المحكمة برفع أوراق الإدانة للمحكمة العليا وتسليم صورة من قرار الإدانة لأطراف الدعوى.
وقال قاضي المحكمة إبراهيم حسن الطاهر الذي أصدر قرار الإدانة، إن المتهم خالف نص المادة 45/ب من قانون الطفل لسنة 2010 مقروءة مع المادة 86/و من ذات القانون، بعد أن ثبت للمحكمة أنه ارتكب جريمة الاغتصاب بحق هؤلاء الأطفال. وأضاف أن المحكمة إستندت في قرارها على خمس قرائن هي تقرير الطبيب بوقوع الاغتصاب والاعتراف القضائي من قبل المتهم وأقوال والدة وخالة المجني عليهم، إضافة لأقوال الأطفال والباحث الاجتماعي. و أوضح القاضي أن المحكمة وجدت عدة قرائن تؤكد ممارسة المتهم لهذه الجريمة عن قصد مع الأطفال، وبما أن قانون الطفل لسنة 2010 يشدد العقوبة في حالة الاغتصاب إضافة لمنشور رئيس القضاء، فإن المحكمة أصدرت قرارها بإدانة المتهم وإعدامه شنقاً حتى الموت.وأسندت رئاسة هيئة الاتهام لرئيس النيابة العامة المستشار بابكر عبد اللطيف وعضوية المستشار ياسر أحمد محمد نائب رئيس النيابة العامة ، فيما مثل الدفاع عن المتهم رئيس هيئة الدفاع المحامي علي عمر أبو المعالي. وشهدت جلسة النطق بالحكم حضور النائب العام المستشار عمر أحمد محمد .

The children’s court of Omdurman along with the other magistrate courts found Bashir Muhammad Ahmad, a thirty-year-old man guilty of defilement of, two boys and a girl; who were siblings their ages ranging from three to five years of age and sentenced him to be hanged to death. The court reached this verdict after finding the accused guilty of all charges against him based on evidence gathered from his confession along with statements from the relatives of the children and the doctor who also performed the medical checkup and found evidence of sexual harassment.
This incident occurred in Al-Salha in the south of Omdurman and the judge that ruled this verdict was Ibrahim Hassan Al-Tahir under the Article 45B and 86 of the Children’s Constitutional Law of 2010. The court passed this verdict basing on five key points evidence; the doctor’s medical checkup that proved that the defilement happened, the confession of the accused, the statements of the children’s mother and their maternal aunt, the statements of the children themselves and the social worker survey.
Babikir Abdullatif, the consulting legal for the court and his deputy, Yasser Ahmad Muhammad, the defense attorney Ali Omar Abu-al-Maali and Deputy Attorney general were all present when the verdict was passed.
